Website Hosting Terms of ServiceThis Terms of Service information (“Agreement”) is an agreement between EMRG a California Corporation (“Company”) and the party set forth in the related order (“Customer” or “You”) , and applies to the purchase of all web hosting services ordered by Customer unless otherwise specified in a separate active contract.
Client Responsibilities
Clients who use our hosting are solely responsible for the quality, performance, and all other aspects of their website and website content. Client assumes full responsibility for the content made public on their website. EMRG does not allow illegal activity on their hosting, and Client acknowledges that EMRG will report any suspicious activity to the authorities.Client is to maintain their website to be free of malware or other malicious software. EMRG reserves the right to quarantine or remove sites that display malware or signs of infection. Client understands that the quarantining or removal of infected site files does not entitle Client to compensation or refunds should their site break. Client is solely responsible for maintaining a safe back-up copy of Client’s website and content.
Billing
Billing is to be processed on an automatically recurring monthly basis via credit card or ACH payment. EMRG does not allow manual invoicing for website hosting. If payment is returned or fails to process for any reason, EMRG may impose a minimum processing charge of $50. In the event of a chargeback or disputed charge, EMRG will bill Client at an hourly rate of $100
Cancellation Policy
Hosting will be provided until termination notice is rendered in writing by either Company or Client with 30-days notice.
